Scope

By engaging SCLK Ltd for consultancy work, using this website, or installing the Proactive add-in, you accept these terms. If you do not accept them, do not use the site or the software.

Consultancy engagements

Support work is scoped in writing before it begins. The agreed scope, duration and rates for an engagement take precedence over these terms where the two differ.

Licence to use Proactive

Proactive Worksets is licensed, not sold. It is currently made available under an evaluation entitlement for evaluation and live project testing; the duration and conditions are set out on the Proactive site. The licence is non-exclusive, non-transferable and may be changed when commercial licensing becomes available.

Acceptable use

You agree not to reverse engineer, decompile, resell or redistribute the add-in, and not to use it to breach a third party’s rights or the terms of your Autodesk licence.

Your responsibility for project outcomes

SCLK supports delivery. It does not assume responsibility for it. Our advice, model work, rule checks and reports are aids to your own review process, and responsibility for compliance, model quality and deliverables remains with you and your project team.

Intellectual property

SCLK Ltd retains all rights in its software, this website, its content and its branding. Your models and project data remain yours. Content we produce for you within a paid engagement transfers on the terms of that engagement.

Availability and changes

Features may change, and support for older versions of Revit may end. We may update these terms; the current version is always published on this page with its revision date.

Liability

The software is provided without warranty of uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of the software or from consultancy work, and our total liability is limited to the fees paid for the engagement concerned.

Governing law

These terms are governed by the law of England and Wales, and disputes are subject to its courts.
